Attemped murder charge for drinking while driving

I have a great idea to stop DUIs DWUIs and stop drinking while driving all together even smoking or doing drugs while in a motor vehicle. The answer is a driver or drunk will have to think about there actions. Heres my opinion if u drink while u drive it should be on your mind that if u get stopped for a dui the charge should be attempted murder. Yes by making DUIs or DWUIs with a charge of attempted murder would probally stop drving under influence or driving while under influence all together or cut stats down by half. Every one knows drinking and driving the vehicle is considered a desdly weapon and if thats true every person who drinks and drives and gets stopped for it should be charged with an attempted murder charge based on how much they had to drink or there ability to drive. And another one of my opinions is the same charge should be given if u text and drive driving while texting is jus as dangerous while being drunk. This is my opinion and i think it should be made into a law. Doest mean it will. If you or anyone has ever had a friend or family member killed by a drunk driver or been in an accident where the other party was texting and u got hurt or worse this opinion is for you. If anyone has anything to discuss about this topic write back give me your thoughts on the subject. My dads an alcoholic i know first had the damage drinking while driving kan do my dad took off in my moms car and he was drunk he got stopped and my moms car was impounded we were the victim of alcohol abuse and we had to pay to get the car out even though we had nothing to do with it. We were the victims and anyone who has been a victim of drunk driving. My staement about my dad is it wasnt his first time he drove drunk either the first time he crashed a van but he or the other driver didnt get hurt but there was alot of damage to the stolen van. See my opinion is that if my dad ever killed anyone while he drove drunk i wouldnt care if he was arressted on an attempted murder charge he should have to pay for his actions. there should be rules about how law officers should abide by them 1 based on thier ability to drive and there BAC and previous record if they have a record of DUIs or DWUIs they shold be charged or if it shuold even be able to be given. Not every one should be given an attempted murder charge but it should be enforced if they have a record. Give me your opinions and beliefs statemets or advice on this topic.

omg i love the idea i just lost a dear friend by a drunk driver last year
and some people just dont care what the price is cuz the guy who hit him has had previous dui's if any thing the bars shold confiscate keys and call a cab for the drinker that should be mandotory unless the have a ride thats not been drinking and hasnt been inside the bar and as for the drinkers at home looking at attempted murder should scare the h$ll outta people i agree with your idea much

If you have been convicted of 2 DUIs this shows a pattern and knowledge; therefore the penalties should be a great deal tougher. For example, if convicted of a 3rd DUI you should get 40 yrs WITHOUT parole. But any distracted driving is VERY dangerous and we ALL are guilty of that. We need to make it not only legally, but social unacceptable to text, talk on the phone, eat, smoke, put on make-up, scream at your kids, etc while driving!

I was an accident investigator for the highway patrol tears ago, and responded to many fatal accidents. Depending on the circumstances, we have brought Manslaughter charges, and have made them stick. For a murder charge, some kind of intent has to be there. A good defense attorney could probably get around the murder charge.
In cases where a death has occurred due to DUI, a public hanging would be a nice idea !

I theory its a good idea and would probably deter many from driving drunk, however, in order for there to be attempted murder charges brought you would have to 1) have a victim which means that you couldn't charge anyone unless they get into an accident so that is still going to have people trying to dodge the system and just not hit anyone. 2) for even an attempted murder charge you would need to show intent to harm the victim. Most people don't drink with the intent to kill someone so that would be very hard to prove in any state. You can however charge people with wreck-less endangerment of others while driving impaired. I also grew up with an alcoholic parent so I know your frustration and pain.

Good idea. Sounds like you put a lot of thought into this. I think that the laws for this should be a lot stricter and then we wouldn't have such a problem. Drinking is laughed at in this society and not in a good way. In fact, drinking is encouraged and thought of highly. That is not a good thing and does need to change. We as a society need to not glorify drinking and drugs anymore. This has got to stop.

my x father in law had 9 dui's b4 they sent his butt to prison he did two years ,after that 2 years he was a freee man !! he manged to get 5 more dui's and drove his car into a house b4 they sent him back. me iam for the death penalty you kill someone while you are under the influance they should pull you out and put a bullet in your head or at least wait tell you sober up. iknow its harsh ! but how many times is to many before society decides that some p.o.s is just a p.o.s!! no matter how you dress it up !

To charge someone with attemped murder while driving under the influence would be a little hard to do. Murder implies the killing of a person with malice and aforethought. There are plenty of laws on the books for manslaughter, the killing of a human "without" expressed or implied malice. DUI is a terrible thing, you are putting everybody on the road around you in danger. I have noticed in the last 10 to 15 years penalties have gone way up for DUI. I wish I knew the answer.

Add talking on the phone, texting and facebooking and you would have a good idea.
Fools who do ANYTHING behind the wheel that takes their concentration away from driving are criminals and should be treated as such.
That is just asking for trouble.
This should be outlawed in every country in the entire world
I am constatnly amazed at the stupid things people do while driving. I've seen eating, putting on make up, drinking hot coffee, phoning, texting, and other crazy things on the highway going 70 miles per hour!

I think it is attempted murder and murder if they cause a wreck and anyone dies. It it the same as playing with a loaded gun and firing it randomly. You may hit and hurt or kill someone. And you did it KNOWING the harm it could cause beforehand. Everyone knows if you drink you can't drink good. So if you do it anyway you KNOW you could wreck and hurt or kill someone. Premeditated. I figure, if you have money for booze, you have money for a cab!!!! Drink one less and buy a ride!!! Or do it in your home. Or have a designated driver. There is NO reason a drinker should drive. Sure, a rare, "I'm in the middle of nowhere with no cell phone and the only person with me needs help so I have to drive them to somewhere." It's awful that people are hurt, kileed or crippled because someone ELSE wanted to drink. WHy should innocent people suffer for others pleasure or addiction?! There are too many safe alternatives!!!!!!! The best one is : Quit drinking!
